'Sign your own death warrant' Furious Theresa May DARES Lords to vote down Article 50

THERESA May has belittled peers in the House of Lords, claiming they will be signing their own “death warrant” if they dare to defy the will of the people by voting not to trigger Article 50.

Ahead of the Supreme Court appeal - starting Monday - against the High Court’s decision that Parliament must pass a vote before the Prime Minister can trigger Article 50, Theresa May has come out fighting.


Mrs May insists any attempt made by pro-Remain peers in the House of Lords to block Brexit will lead to the demise of the second chamber.

If the Lords were seen to be frustrating the will of the people to an extent, it might well be the case that they are signing their own death warrant

A Downing Street minister insisted the Prime Minister is confident the Lords “would not dare” vote down Article 50 - thereby blocking the result of the EU referendum.

The minister said: “If the Lords were seen to be frustrating the will of the people to an extent, it might well be the case that they are signing their own death warrant.”

Although the Government’s rhetoric appears to suggest it is anticipating defeat in its appeal, it nevertheless shows ministers are unwilling to bow down to pressure from Remoaners.

A source close to the Prime Minister told The Telegraph: “Theresa has made clear that the people bringing this legal action over Article 50 must not be allowed to thwart the will of the people.

“She will take exactly the same approach in the Commons when she addresses MPs.”

In an effort to stop the Lords from tabling a long list of amendments to Article 50, Tory whips are said to have drafted a simplified Article 50 Act, which peers will not be able to claim promotes a “hard” Brexit.

Iain Duncan Smith, the former work and pensions secretary and senior Leave campaigner, said he was confident Theresa May will be able to stick to her schedule of invoking Article 50 by March next year.

Professor Mark Elliot, of Cambridge University, who believes Theresa May should be able to use her prerogative powers to initiate the Brexit process, said the law did not guarantee European Union rights.

The academic responded to radio host John Humphrys on Radio 4’s Today program, who said “you argue that we’ve had a referendum, the vote has been taken, the people have spoken”.

He replied: “Well I think legally it’s more complex than that, the Government’s position is that legally it has the power to trigger Article 50 and it makes that argument in the Supreme Court, in its written arguments.

“It says that this is because the legislation that’s already in place that was passed when Britain joined the European Union in  1972, it doesn’t really guarantee that people will always have European Union law rights.

“It simply says that they will have those rights, in effect, as long as Britain remains a member of the EU and on that view, Article 50 can be triggered by the Government using these prerogative powers without the need to go back to Parliament because it isn’t in effect undermining the legislation that’s already in place.”

The comments come after he argued in favour of the Government’s case in a series of essays.

In one, he said: “There is, in fact, no relevant conflict between the European Communities Act 1972 and the prerogative.

“Triggering Article 50 does not in itself ‘change any part of the common law, or statute law, or the customs of the realm’, and therefore does not breach the principle… that the prerogative cannot be used to do such things.”

Also speaking on the show was Professor Alison Young, of Oxford University, who argued in favor of Parliament triggering Article 50.

She said: “It is not about trying to say ‘do we or do we not leave Europe’, it’s trying to say ‘if we’re going to go away and trigger Article 50, we have to make sure we do this in the legally correct way’.

“So what the court is doing is checking to make sure that however we leave the European Union, we do it in the proper way and if that requires the consent of Parliament, then Parliament is a democratic body, it too will take into account the will of the people and the referendum result.

“So I don’t see why making sure this is done legally correct necessarily means you’re ignoring the will of the people.”

The comments come after investment manager Gina Miller led the High Court case to stop the Government from triggering Article 50 without a parliamentary vote.

The Government’s appeal will be heard by the Supreme Court on Monday.
